new helmet requirement for utvs in Ca

Postby kampingkris » Mon Jul 30, 2012 6:20 pm

Figures... this one kinda got approved quickly. Beginning Jan. 1, all utv riders have to wear a helmet in Ca. There's also something about kids not being able to ride, but I didn't really pay attention to the details as I don't have any little ones anymore. SO... was thinking of a new helmet anyway.. this is motivation..

Here's a good view of it: http://leginfo.ca.gov/pub/11-12/bill/as ... ptered.pdf

Nothing about kids except that you must be 16 to operate one or will be supervised by an adult if under 16. Other than that, helmets, seatbelts and factory seat required for all riders.

Not terribly surprising really, it brings them into line with ATVs and the mandated seatbelt use is not surprising either.

That is dumb and smart.

See...here's the problem. In a Jeep....on the Rubicon...going 5 MPH...I don't need a helmet, door, whatever. In RZR....going 5 mph with a cage....there's no reason either.

38604. A person operating a recreational off-highway vehicle shall not
ride with a passenger, unless the passenger, while seated upright with his
or her back against the seatback with both feet flat on the floorboard, can
grasp the occupant handhold with the seatbelt and shoulder belt or safety
harness properly fastened

To me this section would applie to children or migets...................so all those families that purchase 4 seaters to take the fam out,,,,,,,,,,,well unless your kids feet sit flat on the floor i guess they have to stay home.

Ridiculous. You don't have this requirement in a car!! People put kids in child seats all the time.

Honestly...I only see this being enforced at an SVRA.
